Please read these Terms of Service and End User License Agreement (together, the "Terms") carefully. They are a legal agreement between you and CaffeineMog covering your use of the Caffeine Mog mobile app and related services (the "App").

There is an important caffeine-safety section below (Section 7). Please read it.

1. Accepting these Terms

By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the App.

If you are between 13 and 18 years old, you must have your parent or legal guardian read and agree to these Terms with you, and your continued use means they have done so.

2. Who can use the App (Eligibility)

• The App is for users who are 13 years of age or older.
• The App is not intended for children under 13, and they may not use it. (See our Privacy Policy for how we handle children's data and COPPA.)
• If you are under the age of majority where you live (often 18), you may use the App only with the involvement and consent of a parent or guardian.
• By using the App, you confirm that you meet these requirements and that the information you give us is accurate.

3. Your account

• You may need an account to use some features. Keep your login details secure and don't share your account.
• You're responsible for what happens under your account, unless it's caused by our failure.
• Tell us promptly at support@caffeinemog.com if you think your account has been compromised.
• You must give accurate information and keep it up to date.

4. Your license to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as allowed by these Terms and the Apple App Store rules. We (and our licensors) keep all rights, title, and interest in the App.

You agree not to:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse engineer, decompile, or try to extract the source code, except where the law expressly allows it.
• Use the App in any unlawful way or to break these Terms.
• Interfere with, disrupt, or overload the App or its servers.
• Use bots, scrapers, or automated means to access the App or its data, except as we expressly allow.
• Get around, disable, or interfere with security or usage limits.

5. Acceptable use

Be respectful and lawful. When using the App (including names, photos, tier lists, and crowdsource submissions), you agree not to:

• Post or share content that is illegal, hateful, harassing, threatening, sexually explicit, or harmful to minors.
• Impersonate anyone or misrepresent your affiliation.
• Upload anything that infringes someone else's rights (including copyright or trademarks).
• Submit false, misleading, or spam information — including to the caffeine crowdsource queue.
• Collect or harvest other users' information.

We may remove content or limit, suspend, or terminate accounts that break these rules.

6. Caffeine and product information — accuracy disclaimer

The caffeine values, product details, and nutrition figures shown in the App come from third-party and crowdsourced sources, including Open Food Facts, Nutritionix, our own curated lookup table, and submissions from other users.

This information may be incomplete, out of date, or inaccurate. It is provided for general information only.

• Always check the actual product label for the real caffeine content and ingredients before relying on it.
• Do not rely on the App's figures to make decisions about your health or consumption.
• We do not guarantee the accuracy, completeness, or reliability of any caffeine or product information in the App.

7. ⚠️ Caffeine Safety — Please Read

This section is important. Please read it carefully.

What Caffeine Mog is

Caffeine Mog is a collection, cataloging, logging, and informational app for energy drinks. You can scan and catalog drinks, build tier lists, log drinks you've had, and progress through a playful, caffeine-themed rank system.

How progression works — and what it is not

We want to be transparent about the game mechanics so you can use the App responsibly.

• Your rank and progression are based on your Collection Score — the rarity of the drinks you collect (how hard they are to find) and how many distinct drinks you've scanned. Collecting rarer and more varied drinks moves you up.
• The amount of caffeine you consume does not raise your rank. Higher-caffeine drinks do not rank you up faster. The App may display your caffeine intake (for example, a daily total) as information only — it does not affect your rank.
• The App includes a daily streak: scanning on consecutive days builds a streak that can multiply the points each newly collected drink earns. This rewards regular use of the App. It does not require you to drink anything — you can scan and collect a drink without consuming it.
• These mechanics exist only to make the App fun and engaging. They are NOT a recommendation, encouragement, dare, challenge, or reward to drink caffeine, to drink more than you otherwise would, or to drink every day.

Never consume caffeine or energy drinks — or more of them than you otherwise would — just to maintain a streak, earn a rank, unlock a bonus, or move up in the App. A rank or streak is never worth your health. You can fully enjoy Caffeine Mog by collecting, rating, and organizing drinks without increasing your own consumption.

Stay within recommended limits

The U.S. Food and Drug Administration (FDA) has cited 400 milligrams of caffeine per day — roughly the amount in four to five cups of coffee — as an amount not generally associated with dangerous, negative effects for healthy adults.

This figure is for healthy adults only. It does not apply to everyone.

• It does not apply to minors (under 18), to people who are pregnant or breastfeeding, to people who are sensitive to caffeine, or to people with heart conditions or other health conditions. For these groups, safe limits are lower or zero.
• Health authorities, including the American Academy of Pediatrics (AAP), discourage caffeine and energy-drink consumption by children and adolescents.
• Caffeine amounts vary widely between products, and energy drinks may contain other stimulants. Always read the label.

The App does not give medical advice

Caffeine Mog provides information and entertainment. It does not provide medical, health, or dietary advice, and nothing in the App is a substitute for professional advice.

• Consult a qualified healthcare professional with any questions about caffeine and your health, especially if you are a minor, are pregnant or breastfeeding, take medication, or have a health condition.
• For official guidance, see the FDA (fda.gov) and your healthcare provider.

Use responsibly — assumption of risk

You are responsible for your own choices about what you consume. You understand the risks of caffeine consumption, and you agree to use the App responsibly and to consume caffeine, if at all, in line with current health guidance and your own healthcare provider's advice. To the fullest extent permitted by law, you assume all risk arising from your caffeine and energy-drink consumption.

8. In-app purchases

The App offers optional in-app purchases of digital items, which may include cosmetic themes, rank items, and other virtual goods.

• All purchases are processed by Apple through the App Store, under Apple's terms and your Apple Account. We do not receive or store your full payment-card details.
• Digital items are licensed, not sold, for use only within the App. They have no monetary value, cannot be exchanged for cash, and cannot be transferred outside the App.
• Prices and offerings may change. Items may be modified or discontinued.
• Virtual items may be lost if your account is terminated or the App is discontinued, except where the law requires otherwise.

Refunds

• All purchases are final, except as required by law or by Apple's policies.
• We do not control and cannot directly issue App Store refunds. Refund requests are handled by Apple under Apple's then-current refund policy. You can request a refund through Apple at reportaproblem.apple.com.

9. Advertising

Caffeine Mog does not currently display third-party ads. If we add advertising in the future, we'll update these Terms and our Privacy Policy first, and any advertising will follow Apple's App Tracking Transparency rules on iOS (you'll be able to decline tracking).

10. Your content and crowdsource submissions

You may create or submit content, such as tier lists, ratings, notes, photos, and caffeine/product corrections to the crowdsource queue ("User Content").

• You keep ownership of your User Content.
• You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, use, reproduce, modify (for formatting/display), display, and distribute your User Content to operate and improve the App — including showing crowdsourced caffeine/product information to other users.
• You represent that you have the rights to submit your User Content and that it doesn't break these Terms or any law.
• We don't guarantee the accuracy of crowdsourced submissions, and we may review, edit, reject, or remove User Content at our discretion.

11. Changes to the App

We're actively developing the App. We may add, change, suspend, or remove features at any time, and we may release updates. Some updates may be required to keep using the App. We aren't liable to you for changing or discontinuing any feature, except where the law says otherwise.

12. Termination

• You can stop using the App and delete your account at any time (see Settings, or contact support@caffeinemog.com).
• We may suspend or terminate your access if you break these Terms, if we're required to by law, or to protect the App or other users.
• When your access ends, your license to use the App ends, and virtual items and content may be deleted (subject to our Privacy Policy and applicable law).
• Sections that by their nature should survive termination (for example, Sections 6–7 and 13–17) will continue to apply.

13. Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law.

• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.
• We do not warrant that the App will be uninterrupted, error-free, secure, or that any information in it (including caffeine and product data) is accurate or complete.
• Any material you access through the App is at your own risk.

Some jurisdictions don't allow certain warranty exclusions, so some of the above may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law:

• We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from or related to your use of (or inability to use) the App.
• This includes any claims related to caffeine or energy-drink consumption, decisions you make based on information in the App, the accuracy of caffeine/product data, or in-app purchases.
• Our total liability for all claims relating to the App will not exceed the greater of (a) the amount you paid us (if any) in the 12 months before the claim, or (b) US $50.

Some jurisdictions don't allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law (for example, for fraud, gross negligence, or personal injury caused by our negligence where the law forbids excluding it).

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless CaffeineMog and its officers, employees, and agents from any claims, damages, losses, and reasonable legal fees arising from: (a) your misuse of the App, (b) your violation of these Terms or any law, or (c) your User Content. If you are a minor, this obligation applies to the extent permitted by law and may rest with your parent or guardian.

16. Apple-specific terms

These Terms are between you and CaffeineMog, not with Apple. Apple is not responsible for the App or its content. You also agree that:

• This license is limited to use on Apple-branded devices you own or control, consistent with the App Store Terms.
• Apple has no obligation to provide maintenance or support for the App. Direct support questions to us at support@caffeinemog.com.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligation; any other claims are our responsibility.
• We (not Apple) are responsible for addressing any claims about the App, including product-liability, legal/regulatory, and consumer-protection claims.
• We (not Apple) are responsible for investigating any third-party claim that the App infringes intellectual property rights.
• You represent that you are not in a US-embargoed country or on a US prohibited-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

17. Governing law and dispute resolution

• These Terms are governed by the laws of New York, USA, without regard to conflict-of-laws rules.
• We'll try to resolve disputes informally first — please contact us at support@caffeinemog.com.
• Any dispute we can't resolve informally will be handled by the state or federal courts located in New York, USA, and you and CaffeineMog agree to the personal jurisdiction of those courts. We do not require binding arbitration or a class-action waiver.
• Nothing here removes any rights you have under mandatory consumer-protection laws in your home jurisdiction.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Effective date" and notify you in the App or by other reasonable means. Changes are not retroactive. Your continued use of the App after changes take effect means you accept the updated Terms. If you don't agree, stop using the App.

19. Miscellaneous

• Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us about the App.
• Severability: If any part is found unenforceable, the rest stays in effect.
• No waiver: If we don't enforce a right, that's not a waiver of it.
• Assignment: You may not assign these Terms; we may assign them to an affiliate or successor.
